SC to Center: Review ‘internet shutdowns’ and ‘Section 144’ in J&K within seven days

The Supreme Court on Thursday had asked the government to review actions in the newly formed union territories by lifting all curbs under the constitution made as an excuse for emergency. The court has asked the administration to lift the ban on internet as it stands between the citizens right to access of internet within seven days or face legal challenges.

Repetition of Section 144 in the region is an abuse of power whereas suppression of legitimate expression and their use needs to be justified by concern of immediate violence.

A three member bench was set up for the complete lock-down in Kashmir over the last five months since the abrogation of Article 370 after which the two states were made into two union territories. The right to internet access is a fundamental right under Article 19(1)(a) of the Constitution, while total shutdown is a ‘drastic’ measure that needs to be considered at times of ‘absolutely necessary’, the Supreme Court said.

The Supreme Court has asked the state administration to review orders on unlawful assembly (Section 144) and Internet shutdowns with the seven day dead line for which weekly previews of the case will be held.
