New Delhi: The Supreme Court on Wednesday rejected the plea filed by one of the four main accused, Akshay Thakur, who is being convicted on May 5 filed a petition review death penalty in the brutal murder and gang rape’ case asking the court to reconsider his punishment.
A bench comprising three judges, Justice R Banumati, A S Bopanna and Ashok Bhushan was constituted on Tuesday, rejected the plea saying there is no need to review the judgement over and over when the evidence provided by the lawyers has already been examined.
The convict Akshay Thakur, wanted 3 weeks grant asking for sending him a mercy plea from the President of India but the bench denied the permission to do so.
The convicts Akshay (33) Mukesh (30), Pawan Gupta (23) and Vinay Sharma (24) brutally gang-raped 23 year-old paramedic student in a moving bus on the intervening night of December 16, 2012. The girl died because from her injuries 13 days later on 29 December 2012 in a hospital in Singapor where she was taken for recovery.
On December of 2012, a review committee was formed to study the case and formed a new law after which 6 fast-track courts were created along with that the review committee took suggestions and Criminal Law (Amendment) Ordinance, 2013 was passed along with few other laws to hear crimes against women. The committee took public suggestions and submitted the report indicating the failures on the part of government and police as the root cause behind crimes against women in India.
After this case became a landmark many women came forward to file a crime report in fast track courts. The Indian media gave the name ‘Nirbhaya’ meaning ‘fearless’ to the girl making it the symbol of women’s resistance around the world.
Two other accused Ram Singh and Mohammad Afroz alias Raju served 3 years in jail. While Ram Singh committed suicide during the trial period in a cell in Tihar jail where he was kept on 11 March 2013. During this time Afzor, a juvenile was also convicted of rape and murder was sentenced for 3 years in a reform facility after which the remaining 4 were sentenced to death on 13 March 2014 by the Delhi High Court.
